Jerry's BidLiveTerms of Service

1. Acceptance
By creating an account or using Jerry's BidLive (the "App"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility & your account
You must be at least 18 years old and legally able to form a binding contract. You are responsible for everything that happens under your account and for keeping your credentials secure.
3. We are a venue — not a party to sales
Jerry's BidLive LLC is a platform that connects buyers and community sellers. We do not own, inspect, appraise, endorse, warrant, or take possession of any item, and we are not the buyer, seller, auctioneer, or a party to any transaction. All listings, bids, payments, shipping, taxes, and disputes are solely between buyers and sellers. You use the App and transact entirely at your own risk.
4. Bidding & sales
Placing a bid is a binding offer to buy at that amount. If you are the winning bidder, you are obligated to complete the purchase on the seller's stated terms. Sellers are solely responsible for the accuracy of their listings, the legality, ownership, authenticity, and condition of items, and for fulfillment. We do not guarantee any item, description, price, sale, payment, or user, and we are not responsible if a buyer or seller fails to perform.
5. You are responsible for your actions & content
You are solely responsible for your listings, bids, messages, live streams, and all other content and conduct, and for complying with all laws that apply to you — including auction, sales, tax, consumer-protection, licensing, and export laws. You represent that you own or have all rights to your content and that it does not infringe any right or violate any law. You assume all risk arising from your content, your transactions, and your interactions with other users.
6. Zero tolerance for objectionable content
You will not post, stream, or transmit content that is unlawful, harassing, hateful, threatening, violent, sexually explicit, defamatory, deceptive, infringing, or otherwise objectionable, and you will not abuse, harass, or endanger other users. We have zero tolerance for objectionable content and abusive users. You can report content and block users inside the App; we review reports and may remove content and suspend or terminate accounts, generally within 24 hours.
7. Prohibited items & conduct
You may not list, sell, or promote anything illegal, stolen, counterfeit, recalled, hazardous, or otherwise restricted (including weapons, ammunition, drugs, alcohol/tobacco where prohibited, live animals, human remains, or anything you may not lawfully sell). You may not engage in fraud, misrepresentation, shill or manipulative bidding, money laundering, or attempts to interfere with, scrape, or circumvent the App or its security.
8. License to your content
You keep ownership of your content. You grant Jerry's BidLive LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, display, transmit, and distribute your content for the purpose of operating, improving, and promoting the App, and you grant other users the right to view your public content within the App. This license continues for content others have shared or that is retained in backups.
9. Live streaming & recording
If you broadcast, you consent to your stream being transmitted to viewers and, where indicated, recorded for replay. You must not stream any person without their consent, or capture or share anything you have no right to distribute. You are responsible for the legality of what you show and say on a live stream.
10. Moderation, suspension & termination
We may, at our sole discretion and without liability, remove or restrict content, limit or withdraw features, and suspend or terminate any account at any time, with or without notice, including for any actual or suspected violation of these Terms or any law.
11. Disclaimers
THE APP AND ALL CONTENT, ITEMS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, secure, or error-free, or that any item, listing, description, or user is authentic, accurate, lawful, or trustworthy.
12. Assumption of risk
You knowingly accept the risks of buying and selling online and of participating in live, user-generated interactions, including the risk of loss, fraud, misdescription, non-payment, non-delivery, or harmful conduct by other users, and you assume full responsibility for your decisions.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JERRY'S BIDLIVE LLC AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, ITEMS, OR FUNDS, ARISING FROM OR RELATED TO THE APP OR ANY TRANSACTION OR INTERACTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM OR (B) US $100. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you; nothing here limits liability that cannot be limited by law.
14. Indemnification
You will defend, indemnify, and hold harmless Jerry's BidLive LLC and its owners, operators, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your content, your conduct, your transactions, your use of the App, or your violation of these Terms, any law, or any third-party right.
15. Third-party services
The App relies on third-party providers (for example, hosting, authentication, live video, and push notifications). We are not responsible for third-party services, and your use of them may be subject to their own terms and privacy practices.
16. Governing law & dispute resolution
These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict-of-laws rules. Except where prohibited, any dispute will be resolved by binding, individual arbitration, and you and Jerry's BidLive LLC each waive any right to a jury trial and to participate in a class or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing contact@jerrysbidlive.com. Where arbitration or the class-action waiver is unenforceable, disputes will be heard exclusively in the courts located in Allen County, Kentucky.
17. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted; your continued use of the App means you accept them. We will update the effective date and, for material changes, provide notice in the App.
